The defendant is charged with one count of aggravated unlicensed operation in the third degree (VTL ΓΒ§ 511[1][a]) and one count of unlicensed driving (VTL ΓΒ§ 509[1]). Defendant has moved to dismiss the accusatory instrument on the ground that he has been denied his statutory right to a speedy trial, pursuant to CPL 170.30(e) and CPL 30.30(1)(c). The resolution of the motion turns on whether the documents submitted by the People are sufficient to corroborate the allegation in the complaint that defendant knew or had reason to know that his license to drive had been suspended or revoked, which is an essential element of aggravated unlicensed operation. For the reasons set forth below, the Court finds that the People have not corroborated this allegation and therefore grants defendants motion.
