On order of the Court, the motion for reconsideration of this Court's order of March 30, 1999, is considered, and it is GRANTED. Our order of November 10, 1998, directing the prosecutor to show cause why the case should not be remanded to the circuit court for a hearing, provided for appointment of counsel for the defendant to reply to the prosecutor's response to the order if the circuit court found defendant to be indigent. It appears that the defendant took the necessary steps to request appointment of counsel, but that request was not appropriately processed. We REMAND the case to the Calhoun Circuit Court for consideration of the defendant's request for appointed counsel, with the opportunity for the prosecutor to oppose the request as indicated in our November 10, 1998, order. If the circuit court determines that the defendant is not indigent or otherwise not entitled to appointment of counsel, the court must promptly notify the Clerk of this Court. If counsel is appointed, a reply to the prosecutor's response to the order to show cause must be filed within 28 days of the order of appointment. We retain jurisdiction.
